11Ants believes in the importance of thoughtfully handling personal information and is committed to privacy practices that are transparent and compliant. This Privacy Statement sets out how 11Ants uses the personal information we collect and receive about you.


1. Overview.


11Ants obtains personal information about you from various sources to provide our services and to manage our site. You may be a visitor to our site, our Customer, or a loyalty member or customer of one of our Customers. If you are a loyalty member or customer of one of our Customers, 11Ants will generally not collect your personal information directly from you. In this instance, your agreement with our Customer should explain how your personal information is shared.


2. Personal Information We Collect.


Information We Collect Directly from You - We may collect Information directly from you. For example, we collect the personal information that you submit to us via online forms and surveys, and when you contact us by email. When you are provided access to 11Ants services online we collect your full name, email address, job title and account log-in credentials. 


Information We Collect from Our Customers – As a provider of analytics services, we may collect, use and disclose personal information about our Customers’ loyalty members or customers when we act as a service provider. 11Ants Customers are responsible for making sure that their customer’s privacy rights are respected, including ensuring appropriate disclosures about third party data collection, use and disclosure. Our Customers will also provide us with necessary information to invoice them and to hold a commercial relationship with them, this will include employee, names, work email addresses, and telephone numbers. 


Information Automatically Collected About You - We also automatically collect Information through your use of our site using cookies and other technologies. This Information may include, information about your operating system, settings and system configurations, IP address, device model, device ID and other unique device identifiers, the webpages you access within our site, the website that led you to our site, the dates and times you access our site, and web log data.

3. How We Use personal information.

Our primary purpose in collecting Information is to provide you with the products and services you or our Customers request and those which improve your use of the site and services, or our Customers’ use of our services. In addition, we may use your information, for the following purposes:

  • Provide and deliver products or services, including software updates;

  • Operate and improve our operations, systems, products, and services;

  • Understand you and your preferences to enhance your experience;

  • Respond to your comments and questions and provide customer service;

  • Provide service and support, such as sending confirmations, invoices, technical notices, updates, security alerts, and administrative messages and providing customer support and troubleshooting;

  • Communicate with you about promotions, upcoming events, and news about products and services;

  • Link or combine information about you with other personal information we get from third parties, to help understand your needs and provide you with better and more personalised service;

  • Carry on a normal business relationship with our customers and suppliers;

  • Enforce our terms and conditions or protect our business, partners, or users; or,

  • Protect against, investigate, and deter fraudulent, unauthorised, or illegal activity.

 
If we need to use your personal information in other ways, we will provide specific notice at the time of collection and obtain your consent where required by applicable law.

As a provider of analytics services, we use the personal information of our Customers’ loyalty members and customers to allow our Customers to understand more about their businesses and loyalty members and customers. This use is in accordance with the terms of our business relationships with our Customers. 

4. How We Share Personal Information.

11Ants works to keep your personal information confidential and secure and does not sell your personal information. In some circumstances, we may share your information with third parties, for example:

  • We may share personal information with other 11Ants entities in order to provide our services and for internal administration purposes;

  • We may share personal information with our service providers. We have service providers that provide services on our behalf, such as identity verification services, site hosting, data analysis, information technology and related infrastructure, customer service, email delivery, and auditing services. These service providers may need to access personal information to perform their services. We authorise such service providers to use or disclose the personal information only as necessary to perform services on our behalf or comply with legal requirements. Our service providers are predominantly located in the United States of America and New Zealand.

  • We may share personal information with third party business partners when this is necessary to provide our services to our Customers. 

  • We share personal information as we believe necessary: 

    • To comply with applicable law, or payment method rules; 

    • To enforce our contractual rights; 

    • To protect the rights, privacy, safety and property of 11Ants, you or others; and,

    • To respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence.

  • Finally, we also share aggregated, anonymised or statistical information about you, including demographics data, with others for a variety of purposes.

 
We may share personal information with our Customers’ authorised third parties as necessary to provide the agreed services. This use is in accordance with the terms of our business relationships with our Customers. 
 
5. Your Rights and Choices.

You have choices regarding our use and disclosure of your personal information and what happens to it. You are entitled to:

  • Have your data processed in a fair, lawful and transparent way;

  • Be informed about how your personal data is being used, an example being this privacy Statement;

  • Access personal data we hold about you;

  • Require us to correct any mistakes in your personal data;

  • Require us to delete personal data concerning you in certain situations where there is no good reason for us to continue to process it;

  • Request that we transfer your personal data to you or another service provider in a simple, structured format;

  • Object at any time to processing of your personal data for direct marketing purposes;

  • Object to automated decision making which produces legal effects concerning you or similarly significantly affects you;

  • Object in certain other situations to our continued processing of your personal data; and,

  • Otherwise restrict or temporarily stop our processing of your personal data in certain circumstances.

If you are a loyalty member or customer of an 11Ants Customer, please direct your requests to our Customer. For example, if you are making, or have made, a purchase from a retailer who uses our services, then you should address your request directly to the merchant.
 

6. Security and Retention.


We take the security of your personal data very seriously. We maintain a comprehensive information security management system (ISMS) and have implemented various strategies, controls, policies and measures to keep your data secure and keep these measures under close review. We protect your data by using encryption techniques and we use other safeguards such as firewalls and password protection. This means that your data is protected and only accessible by individuals who need it to carry out their job responsibilities.  
In order to protect your privacy, we urge you: 

  • To protect against unauthorised access to your use of the site; 

  • To ensure no one else uses the site while the user’s machine is “logged on” to the site; 

  • To log off or exit from the site when not using it; and, 

  • Where relevant, to keep your password or other access information secret. 

 

In broad terms, we will only retain your personal data for as long as is necessary for the purposes described in this Privacy Statement. This means that the retention periods will vary according to the type of the data and the reason that we have the data in the first place.

When you visit our sites or online services, both we and our third-party partners collect information about your online activities over time and across different sites to provide you with advertising about products and services tailored to your individual interests (this type of advertising is called “interest-based advertising”).
